Privacy policy for the amw.pl website and the sklep.amw.pl online shop
We care about your privacy and make every effort to ensure that the personal data we process when you use our website amw.pl or our online shop sklep.amw.pl is protected and processed in accordance with applicable law, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR). In this Privacy Policy we explain everything important about this processing and the rights you have in connection with it.
Who is the controller of your personal data?
The controller of your personal data is AMW Nawrot spółka komandytowa (limited partnership), ul. Ułanów 1, 42-625 Pyrzowice, Poland, tel.: +48 32 284 50 17, e-mail: amw@amw.pl, entered in the Register of Entrepreneurs of the National Court Register (KRS) by the District Court in Gliwice, 10th Commercial Division, under KRS number 0000950373, tax ID (NIP): 6452299087, REGON: 278039825.
How do we obtain your personal data?
We obtain your personal data directly from you.
What personal data do we process?
In all cases we process ordinary personal data, specifically:
- if you create and maintain an account in our online shop, we process your contact details — namely your e-mail address — and any other data you add to your account,
- if you contact us via one of our e-mail addresses or the contact form on our website, we process your contact details (e-mail address) and, if you use the form, also your first and last name,
- if you place an order for products or services in our online shop, we process your identification, contact and billing data (first and last name, phone number, e-mail address, home address, delivery address and bank account number) and, if you run a business, also your tax ID and business name,
- if you submit a complaint or return purchased products, we process your identification, contact and billing data,
- if you subscribe to our newsletter, we process your e-mail address.
If you provide us with special categories of personal data or data relating to criminal convictions and offences, we always delete or anonymise it so that it cannot be read.
For what purposes and on what legal basis do we process your personal data?
Depending on how you use our website and online shop, we process your personal data in order to: provide you with the website’s content and features (performance of a contract — Art. 6(1)(b) GDPR), maintain your account in the online shop (Art. 6(1)(b) GDPR), handle your enquiries and requests (Art. 6(1)(b) GDPR), fulfil orders (Art. 6(1)(b) GDPR), handle complaints and returns (legal obligation — Art. 6(1)(c) GDPR), keep accounts and records (Art. 6(1)(c) GDPR), carry out sales analyses and statistics and market our own products (our legitimate interest — Art. 6(1)(f) GDPR), send our newsletter (your consent — Art. 6(1)(a) GDPR) and establish, exercise or defend legal claims (Art. 6(1)(f) GDPR).
Do you have to provide your personal data?
Providing the personal data needed to create and maintain an account, contact us, place an order or submit a complaint is necessary for us to carry out these actions — without it, we will not be able to do so. Providing any other data is entirely voluntary.
Who do we share your personal data with?
We take the confidentiality of your data seriously. We may share it with:
- service providers working on our behalf — IT solution providers, electronic payment operators, courier companies and waste disposal companies,
- public authorities,
- the persons you indicate as recipients of the products or services ordered.
Data is always shared with external recipients on a legal basis and, in the case of our service providers, also under data processing agreements.
Is your data transferred to third countries?
As a rule, we do not transfer your personal data to countries outside the European Economic Area or to international organisations. The exception is contact via WhatsApp — see “Contact via WhatsApp and the contact widget” for details. Should this change, we will inform you in good time.
How long do we process your personal data?
- to the extent required by tax and accounting regulations — for 5 years from the end of the calendar year in which the tax payment deadline expired or the transaction was settled,
- to the extent resulting from our legitimate interests — for as long as those interests exist, but no less than 2 years,
- to the extent based on your consent — until you withdraw it.
What are your rights?
In connection with the processing of your personal data, you have the right to: request access to your data, request its rectification, request its erasure, request restriction of processing, object to processing based on our legitimate interest, data portability, withdraw your consent at any time and lodge a complaint with the President of the Personal Data Protection Office (UODO) in Poland. Before contacting the supervisory authority, we encourage you to get in touch with us — we’ll be happy to clear up any questions.
Automated decision-making and profiling
Your personal data is not subject to automated decision-making or profiling.
Contact via WhatsApp and the contact widget
Our website features a contact widget with “WhatsApp”, “Call” and “E-mail” buttons. The widget itself does not load any third-party scripts or cookies and does not pass your data to anyone — these are simple links that only work once you click them.
If you choose WhatsApp, you will be redirected to the WhatsApp app or website and the conversation will take place via that service. We then process your phone number, profile name and the content of your messages and any files you send, in order to respond to your enquiry and, where applicable, prepare an offer (Art. 6(1)(b) and (f) GDPR). We keep this data for as long as needed to handle your enquiry and then until any potential claims become time-barred.
The service is provided by WhatsApp Ireland Limited, which also processes data as an independent controller under the terms of its own privacy policy (whatsapp.com/legal). When you use this service, data may be transferred to countries outside the European Economic Area, including the USA, on the basis of the European Commission’s decision on the EU-US Data Privacy Framework or standard contractual clauses. Using WhatsApp is voluntary — you can always contact us by phone or e-mail.
Regeneration reminder
If you leave your first name and a phone number or e-mail address on the regeneration reminder page, we process this data together with the regeneration date, the chosen interval and an optional product description in order to contact you about 2 weeks before your next regeneration is due. The legal basis is your consent (Art. 6(1)(a) GDPR). You can withdraw it at any time by writing to amw@amw.pl. Withdrawal does not affect the lawfulness of processing carried out before it.
We keep the data until you withdraw your consent, and no longer than 6 months after the regeneration date – after that it is deleted automatically. Only authorised AMW Nawrot staff have access to it. To plan the contact we may use a company calendar (e.g. Google or Microsoft), whose provider processes the data on our behalf. A reminder you add to your own phone calendar is stored only on your device or account – we do not receive that data.
Cookies and similar technologies
Our website amw.pl and our online shop sklep.amw.pl use cookies — small text files that allow us to recognise your device, remember your settings and make sure the site works properly. We divide them into essential, analytics and functional cookies and, by how long they are stored, into persistent and session cookies.
On amw.pl we use cookies that the website needs to work: confirmation of your cookie choice (essential, 12 months) and your chosen language version (functional, 12 months). Only if you consent to analytics cookies, Google Analytics cookies (_ga, _ga_*) are also set; they are stored for up to 2 years.
In the sklep.amw.pl online shop we also use cookies relating to your browser session, recently viewed products, ratings you have given, authentication data and the contents of your basket.
You can delete cookies or disable them in your browser settings at any time. However, this may limit the availability of some features of our website and shop.
On amw.pl we use Google Analytics 4 (Google Ireland Limited) to understand how visitors use the website – for example which pages they view and which country they come from. It runs only after you consent to analytics cookies (Art. 6(1)(a) GDPR); without your consent no analytics cookies are set. Google may process the data on servers outside the European Economic Area, including in the USA, on the basis of the European Commission’s decision on the EU-US Data Privacy Framework. You can withdraw your consent at any time via “Cookie settings” in the footer of the website. We do not use marketing tools. To protect the contact form against spam, we use Google reCAPTCHA (Google Ireland Limited); the information it collects is used only for that purpose.
